NEED A LAWYER !!!

Have you ever thought you need a law degree to understand alllllllll the laws in your state on hunting and fishing?.........good lordy I do!!........heres an example....I email 2 high ranking members of our F&G department asking about number of rounds in a magazine for a semi rifle, non-rimfire....one says you can have 4 in the magazine and 1 in the chamber for a total of five....the other says you can have 5 in the magazine and 1 in the chamber for a total of six !?...which ones right?....I give up...but I am going with the higher amount and if I ever get cited I have it in writing from their own department so bring it!!!! :eyebrow:

We can only hunt open fields right now....... Try asking our DNR to define OPEN FIELD....... The only response you will get is "No trees"  Try finding that in WV........... :roflmao: :roflmao:

They say it is to keep poaching down... :confused:  You would think a poacher would do it anyway I do not think another law will stop them...... :nono:  :laf:

Water fowl and deer gun season you have to have the plug in your shot gun......

But I can have 6 shots in my 45 revolver or load up my semi auto pistol and have as many shots as it can carry (if my memory serves me right )  :shrug: :confused:

Laws never stop poachers or criminals. 

But if your shotgun is plugged and/or you don't carry buckshot on your person, it might keep temptation away from the law abiding hunter.

207:3 Lawful Methods of Taking. â€"
    I. Wildlife shall be taken in the daytime between 1/2 hour before sunrise and 1/2 hour after sunset with a gun fired at arm's length or bow and arrow, unless otherwise specifically permitted.
    II. A full automatic rifle shall not be used at any time nor shall a semi-automatic rifle be used to which is attached a magazine or clip holding more than 5 cartridges, nor shall a full jacketed metal case bullet be used, either in its original form or any alteration thereof.


So what's your question?   If there is a round in the chamber - it is NOT in the clip.   Capice?

All you have to do when asked is to drop the clip.   Count the rounds, hand him the RSA and go on your merry way.

No lawyers needed.   The law does not say you can not have 6 rounds in your gun.   It says you can not have more than 5 rounds in a clip or magazine.   

This does not apply to rimfire rifles

Read the RSA.   It doesn't matter how a Conservation Officer interprets the law, what matters is if you are in compliance with the law.

The law says, 5 rounds in a clip or magazine.   Weather you have a round in the chamber or not, is not even relevant.   It's how many rounds you have in a clip or magazine.    It's really pretty simple.

Yeah my common sense leads me to believe after your posts on the coon hotspot and all the wrong info you were giving the fellow from out of state on the law on carrying guns in your car that your a blowhard and know it all, and not overly bright,so common sense dictates that i take anything you say with a grain of salt , but I think that perception of you is..pretty common anyways  :wink:

Forget all the spin and name calling - tell me this -

why is it that a guy who claims to be a hunter is just NOW reading the Fish and Game Digest and trying to figure out the laws?  That's pretty scary bud.

Then again, knowing that you associate with a poacher, I'm really not that surprised.

After a long and careful assessment of your frequent and hostile interactions with others I have come to the learned hypothesis that your suffering from a terminal case of TPS! (Tiny Pecker Syndrome) :eyebrow:

Night hunting with a centerfire rifle in a shotgun and rim fire only area

Baiting out of season

Baiting without written land owner permission

Baiting without providing the local conservation officer with the required paperwork (maps, permission)


And when confronted about it, and told it was poaching, the reply was, and I quote "They're just coyotes.   No one cares.   The game warden will probably thank me for killing them."


That should answer the allegations of weather or not a certain friend of yours is a poacher or not.    And it should answer why I have such a dislike for the man, and why I stopped hunting with him.   



You made a statement about the number of rounds in a clip or magazine.   

That law has been on the books for years, although it was changed just about 3 years ago to read Rim Fire when it used to specifically say, 22 cal.    It was changed at the request of sportsmen and the wildlife federation to accommodate the 17 HMR and HM2 rifles.   Owning a 17 HMR, I went through this with the Fish and Game department about 4 years ago.   I can't spell the Sgt's name at Fish and Game's Law Enforcement division,  Bontfelou or something like that, but we went over this at length.   

How you load your weapon, the number of rounds you choose to use, is up to you.  The law says you can have a clip with 5 rounds in it.    If you choose to hunt with one in the chamber and 4 in the clip that's your choice.   If you choose to hunt with one in the chamber and 5 in the clip, you would be legal in NH.   

Most of the Conservation Officers are out there to do a job for each of us.  It's dangerous, they often work long hours, and risk their lives to help others.   They are not out there to screw you over.   You work near the state complex on Hazen Drive?   Take a ride over to Fish and Game and talk to them.   You'll come away with a different perspective I am sure.   You dont need to be a lawyer to understand the fish and game laws.    All you need to be is a conscientious sportsman with an open mind and some common sense.   If you dont have or are not that, you dont belong in the woods anyway.

A man who professes to have a masters degree, should not have a difficult time with laws written so good old boys like me can understand them.
